NRC OFFICE OF INVESTIGATIONS REPORTS 1-96-007, 1-96-014, 1-96-034, 1 AND 1-96-048

Dear Mr. Bowling:

This letter refers to several investigations conducted at the Millstone Nuclear Power Station and the Haddam Neck Plant by the NRC Office of Investigations (01) Field Office, Region 1.

These investigations, conceming multiple Northeast Utilities (NU) employees, were initiated to determine whether the employment of those individuals was terminated by NU on January  ;

11,1996, in retaliation for having engaged in protected activity by raising safety issues. 1 A comprehensive review of NU's workforce reduction process, as it applied to employees who

, had previously engaged in protected activities, was conducted by the NRC, including a review of the "Workforce Reduction Matrices" and the " General Release and Covenant Not to Sue."

The "Workforce Reduction Matrices" were used to rank employees by department, in order to  ;

select the lowest ranking employees for termination. The " General Release and Covenant . 1 Not to Sue" was offered to the terminated employees as part of a severance package, if they chose to sign it. Based upon its review of this matter, the NRC staff concluded that there was not sufficient evidence to substantiate the allegations of discrimination. )'- ,

. Additionally, we have concluded that the " General Release and Covenant Not to Sue" did not  ;

violate 10 CFR 50.7(f) and was otherwise not objectionable insofar as the NRC's primary

- interests were concemed.

h/ J In a related matter, we note that you have initiated actions to address the NRC Order dated '

. October 26,1996, to establish a " safety mnscious work environment" program, strengthen l leadership skills, and foster a team-building relationship between management and the

.workforce to preclude future actual or perceived incidents of the type that prompted these investigations.
