CATAWBA NUCLEAR STATION, UNITS 1 AND 2 RE: IMPLEMENTATION OF THE CONDITIONS IMPOSED BY RG 1.147, REV.12, ON ASME CODE CASE N-522 (TAC NOS. MA6118 AND MA6119)

Dear Mr. Peterson:

On February 17,1995, as a result of a request for relief made by you, we authorized Duke Energy Corporation (Duke) to use Code Case N-522 as an alternative to the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code. In our letter we stipulated that the alternative is good until"such time as the code case is published in a future revision of Regulatory Guide (RG) 1.147. At that time, if you intend to continu: to implement this code case, you should also implement any limitations issued in RG 1.147." Revision (Rev.) 12 was recently issued in May 1999.

By letter dated July 20,1999, you stated that you currently do not and cannot comply with a new condition imposed by Rev.12. Specifically, this condition requires that testing be conducted at the peak calculated containment pressure and the test procedure should permit the detection and location of through-wall leakage in containment isolation valves and pipe segments between isolation valves. Implementation of this new condition would require revisions to numerous procedures and the reorientation of the plant's inspection / testing personnel resources. Consequently you proposed to fully comply with the requirements of Section XI or comply with the new conditions of RG 1.147, Rev.12, by May 1,200')._X% _

indicated that this is a reasonable time frame to implement the new requirements. You also stated that meanwhile you will continue to test the applicable structures / systems / components in accordance with the current NRC-approved program.

We have concluded that postponing implementation of the new conditions imposed by RG 1.147, Rev.12, is acceptable since our evaluation on the relief was based on implementing the code case for the duration of the inspection interval. Therefore, the relief request khb i<or i 2 p< pi i O
