. CATAWBA NUCLEAR STATION, UNITS 1 AND 2 RE: SAFETY EVALUATION OF YOUR RESPONSE TO GENERIC LETTER 96-05 (TAC NOS. M97030 AND M97031) j On September 18,1996, the NRC issued Generic Letter (GL) 96-05, " Periodic Verification of Design-Basis Capability of Safety-Related Motor-Operated Valves," requesting each nuclear power plant licensee to establish a program, or to ensura the effectiveness of its current program, to verify on a periodic basis that safety-related motor-operated valves (MOVs) continue to be capable'of performing their safety functions within the current licensing bases of the facility. On November 14,1996, Duke Energy Corporation (then Duke Power Company)

submitted a 60 day response to GL 96-05 notifying the NRC that it would implement the
- requested MOV periodic verification program at the Catawba Nuclear Station, Units 1 and 2. On March 17,1997, Duke submitted a 180-day response to GL 96 05, providing a summary description of the MOV periodic verification program planned for implementation at Catawba. In a submittal dated March 31,1998, Duke updated its commitment to GL 96-05. On March 19, 1999, Duke responded to our January 27,1999, request for additional information.
.We have reviewed Duke's submittals and applicable NRC inspection reports. We recognize Duke's commitment to implement the Joint Owners Group (JOG) Program on MOV Periodic Verification to include all three phases of that program. Based on our understanding of Duke's commitment with respect to GL 96-05, we find that Duke has established an acceptable program to verify periodically the design-basis capability of the safety-related MOVs at Catawba.

- Therefore, we conclude that Duke has adequately addressed the actions requested in GL 96-05 for Catawba Nuclear Station. We may conduct inspections at Catawba to verify the '
implementation'of the MOV periodic verification program is in accordance with (1) Duke's -
commitments; (2) the enclosed Safety Evaluation (SE); (3) the SE dated October 30,1997, on 1the JOG Program on MOV Periodic Verification; and (4) the NRC SE dated April 14,1998, on the Westinghouse Owners Group methodology for ranking MOVs by their safety significance,
