l NOTICE OF VIOLATION Centerior Service Company Docket No.50-440 Perry Nuclear Power Plant License No. NPF-58 During an NRC inspection conducted on October 4 through December 1,1997, a violation of NRC requiremerits was identified, in accordance with the " General Statement nf Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is described below:

Perry Nuclear Power Plant Unit 1 Technical Specification (TS) 5.4.1.a specifies, in part, that written procedures shall be implemented covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 197 Appendix A of NRC Regulatory Guide 1.33, Revision 2, specifies activities that should be controlled by written procedures. requires, in part, that tag-outs be prepared and verified to adequately isolate potent!al hazards to personnel and equipment prior to commencement of wor Contrary to the above, on October 6,1997, personnel begcn work on a reactor recirculation system flow control valve actuator without verifying thtt the tag-out adequately isolated the work area from the reactor coolant system. As a result, the potential hazard associated with low pressure reactor coolant was not isolated from personnel, and conseqrently, equipment and personnel were sprayed with reactor coolan This is a Severity Level IV violation (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Centerior Service Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended or revoked, or why such other action as may be proper should not be taken.
