l NOTICE OF VIOLATION The Cleveland Electric Illuminating License No. NPF-58 Company As a result of the inspection conducted on August 7 through 23, 1989'and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1987), the following violations were l

identified:

10 CFR 50, Appendix B, Criterion XVI requires in part t!.vc measures shall-be established to assure conditions adverse to quality tro promptly

Contrary to the above:

On October 19, 1988, the licensee responded to Notice of Violation 50-440/88012-02 concerning failure to comply with Administrative Controls for overtime hours of unit staff pursuant to Technical Specification 6.2.2.a stating that adequate corrective action had been taken to prevent recurrence.

As detailed in the Diagnostic Evaluation Team Report for the Perry Nuclear Power Plant dated May 1989, Section 3.2.2, a licensee audit identified 9 instances between June and Novetber 1988 where administrative controls were not adhered to.

In addition, licensee Audit 89-12, Action Request 0002, dated July 13, 1989, identified continued failure to adhere to administrative controls for overtime hours of unit staff personnel.

This is a Severity Level IV Violation (Supplement I) (50-440/89022-03(ORP)).

10 CFR 50,. Appendix B, Criterion V requires in part that activities affecting quality shall be prescribed by documented instructions.

Contrary to the above:

As detailed in Section 3.2.3 of the Diagnostic Evaluation Team Report for the Perry Nuclear Power Plant dated May 1989, the licensee failed to provide adequate instructions to control manual throttle valve l

positioning.

This is a Severity Level IV Violation (Supplement I) (50-440/89022-07(DRP)).

10 CFR 50, Appendix B, Criterion V requires in part that activities affecting quality shall be accomplished in accordance with instructions.

Contrary to the above:

On February 20, 1989, the licensee failed to correctly perform Surveillance Instruction (SVI)-M16-T2001 which resulted in an inadequate test.

details of this violation are contained in the Diagnostic Evaluation Team Report for the' Perry Nuclear Power Plant dated May 1989, Section 3.4.1.

This is a Severity. Level IV Violation-(Supplement I) (50-440/89022-15(DRP)).

With respect to item 2, the inspection showed that action had been taken to correct the identified violation and to prevent recurrence. Consequently, no reply to that violation is required and we have no further questions regarding this matter. With respect to items 1 and 3, pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in-reply, including for each violation:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
