50-440 Perry Nuclear Power Plant License No.
NPf-58 During an NRC inspection conducted on October 20 through November 20, 1992, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1992), the violation is listed below:
1 Technical Specification 3.0.3 requires, in part, that when a limiting condition for operation is not met, except as provided in the associated action requirements, action shall be initiated within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> to place the unit in an operational condition in which the specification does not apply.
Contrary to the above, on November 5,1992, upon not being able to comply with the limiting condition for operation action requirements of Technical Specification 3.6.1.2, action was not initiated within I hour to place the unit in Operational Condition 4, COLD SHVIDOWN, where TS 3.6.1.2 does not apply.
This is a Severity Level IV violation (Supplement 1).
Pursuant to the provisions of 10 CFR 2.201, Centerior Service Company is hereby required to submit a written statement or explanation to the U.S.-
Nuclear Regulatory Commission, ATIN: Document Control Desk, Washington, D.C.
20555 with a copy to the U.S. Nuclear Regulatory Commission, Region 111, 799 Roosevelt Road, Glen Ellyn, Illinois, 60137, and a copy to the NRC Resident inspector at the Perry Nuclear Power Plant _within 30 days of_ the date of the letter transmitting this Notice of Violation (Notice).
This reply should.be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:
(1) the reason _ for the violation, or if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the t a ults achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice, an order or a demand for informantion may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
