During an NRC inspection conducted on December 2,1997, through January 27,'1998, and on -

April 9,1998, a violation of NRC requirements was identified, in accordance with the " General

l

Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is

listed below:

Technical Specification 5.4.1 requires, in part, that written procedures / instructions shall be

established, implemented, and maintained covering the following activities. One of the activities

listed is: "The applicable procedures recommended in Regulatory Guide (RG) 1.33, Revision 2,

Appendix A, February 1978."

Appendix A of RG 1.33 lists the Plant Fire Protection Program as an activity that should be

covered by written procedures.-

Part of the Plant Fire Protection Program is implemented by Plant Administrative

Procedure PAP-1913, " Control of Combustibles," Revision 4. Section 6.4.1 of PAP-1913

specifies that a transient combustible permit is required to authorize, track, and document the

use of transient combustible materials when at least one of the following conditions exist.

area / zone containing redundant trains of safety-related equipment, cabling, and associated .

Contrary to the above, on January 6,1998, the inspectors identified combustible material with no

transient combustible permit in a fire area containing redundant trains of safety-related

equipment in the emergency service water pump house.

This is a Severity Level IV violation (Supplement I).

The NRC has concluded that information regarding the reason for the violation, the corrective

actions taken and planned to correct the violation and prevent recurrence and the date when full

compliance was achieved is already adequately addressed on the docket in the response to

inspection Report 50-440/97021, dated March 23,1998. However, you are required to submit a

written statement or explanation pursuant to 10 CFR 2.201, if the description therein does not

accurately reflect your corrective actions or your position. In that case, or if you choose to

respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the

,

U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555,

,

.with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident Inspector

at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting

this Notice of Violation (Notice).
