'The Cleveland Electric Illuminating License No, NPF-58 '
Company As a result of the inspection conducted on July 30 through September 19, 1990, a violation of NRC requirements was identified, In accordance with the " General Statement of Po'licy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2, Appendix C (1990), the violation is listed below:
10 CFR 50,72(b)(2) required that the licensee notify the NRC as soon as practical and in all cases, within four hourslof the occurrence of any event or condition that alone could have prevented the fulfillment of the safety-function.of needed stru.tures or systems.
Contrary to the above, at 12:10. a.m. (EDT), on September 1,1990, plant personnel identified that both; trains-of the control room emergency recirculation system were inoperable and not capable of fulfilling the intended safety function.
Notification to the NRC was'made at 1:00 p.m. on September 1, 1990, which was beyond the four hour notification limit.

Pursuant to the provisions of 10 CFR 2,201, you are required to submit to this-office within thirty days of the date of this NoMce a written statement or explanation in reply, including for each violation:
(1) corrective action taken-and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
