Dear Ms. Garde:

This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), records related to the NRC Comanche Peak Task Force established in March 1984.

We are placing into the NRC Public Document Room (POR) the remaining box of records (box 19) in the QA/QC category, as described on the enclosed Appendix BB; one box of records (box one) in the mechanical / piping category,

which are described on the enclosed Appendix CC; and additional records which are described on the enclosed Appendix DD. The records will be filed in folder F01A-85-59 under your name.

The records identified on Appendix CC at numbers 133 through 135 are being withheld in their entirety from public disclosure pursuant to Exemption (5) af the FOIA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Cotuission's regulations.

Portions of the records identified on Appendix CC at numbers 4, 5, 7 through 11, 21 through 28, 37, 40 through 48, 65, 76, 77, 152, 232, 238 through 240, 260, 277, 283, 313 through 315, and 340 are also being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

The withheld information consists of the advice, opinions, and recommendations of the staff concerning potential violations. The nonexempt portions of these records are being placed in PDR file F01A-85-59 under your name.

The following records and portions of records contain information the disclosure of which would constitute an unwarranted invasion of personal privacy or disclose the identities of confidential sources. The information is being withheld pursuant to Exemptions (7)(C) and (7)(D) of the F0IA (5 U.S.C.

552(b)(7)(C) and (D)) and 10 CFR 9.5(a)(7)(iii) and (iv) of the Connission's regulations. The nonexempt portions of these records are being placed in PDR 8607100085 860630 PDR FOIA GARDE 85-59 PDR J

Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of information pursuant to Exemption (5) are the undersigned and Mr Harold R. Denton, Director, Office of Nuclear Reactor Regulation. The person responsible for the denial of information pursuant to Exemptions (7)(C) and (D) is Mr. Ben B. Hayes, Director, Office of Investigations.

The denial by Mr. Denton and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denial by Mr. Hayes may be appealed within 30 days to the Secretary of the Commission and should be addressed to the Secretary of the Comission.

Portions of the record identified on Appendix BB at number 2 and portions of the records identified on Appendix CC at numbers 2, 3, 6, 12, 49, 66, 67, 89 through 93, 136, 138, 145, 152 through 158, 177 through 179, 218, 219, 223, 232, 233, 241, 242, 261, and 316 contain information subject to the agreement reached between you and the NRC Staff at a meeting on May 8, 1985. Therefore, we are not invoking an F0IA exemption regarding the deletion of this information.

Additional records subject to this request are being addressed under a separate F0IA request, F01A-85-91, from S. Kohn of your organization.

Through public outreach, the Project promotes whistleblowers as agents of government accountability.
