. APPENDIX A NOTICE OF VIOLATION Carolina Power and Light Company _ License Nos.: DPR-62 DPR-71 Based on the results of the NRC inspection conducted on June 12-15, 1978, it appears that certain of your activitics were not conducted in full compliance with NRC, requirements as indicated below. These items have been categorized as described in our correspondence to you dated December 31, 1974. .

A. Appendix B Technical Specification 2.2.1 states that "the concentration of free available chlorine shall not exceed a maximum instantaneous'value of 0.5 mg/2 cor an average value of 0.2 mg/2 during the chlorination periods conducted in a calendar day. -

Contrary to the above, on March 14 and 16,1978, the average free l available chlorine values during the chlorination periods were 0.21 mg/2 and 0.23 mg/2 respectively.

This is a deficiency.

B. Appendix B Technical Specification 3.2.1 requires that a nonroutine report as specified in Section 5.4.2 shall be made for any measurement of free available chlorine or total residual chlorine that is in excess of the effluent limitations prescribed by the U. S. Environmental Protection Agency and the state of North Carolina in the permits and certificates issued to the licensee pursuant to the provicions of Section 401 and 402 of PL-92-500. Appendix B Technical Specification 5.4.2.a requires that a written report shall be made to the Director of the appropriate regional office (copy to the Director of Nuclear Reactor Regulation), within 14 days of an environmental event.

Coatrary to the above, the licensee failed to submit the required conroutine report.

This is a deficiency. ,

Carolina Power and Light Co. Appendix A License Nos. DPR-62 and DPR-71 Notice of Violation C. Appendix B Technical Specification 5.3.4 states that written procedures shall be prepared _ and approved as specified in Section 5.3.5 for operation and carrying out the Environmental Surveillance Programs described in Section 4 and those surveillance programs described in Section 3 which are not associated with the environmental protection conditions.

Appendix B Technical Specification 5.3.5. states that for those Environmental Surveillance Programs carried out off-site, a procedure , review and approval program will be established adequate to ensure the, accuracy of the program and results.

Contrary to the above, inspection disclosed that procedures for Technical Specifications 4.1.1 (entrainment) 4.1.2 (impingement), and 6.1 (Marsh Productivity) were not approved.

This is a deficiency.
