ENCLOSURE I NOTICE OF VIOLATION -

1 Carolina Power and Light Company Docket Nos. 50-325 and 50-324 i Brunswick Steam Electric Plant License Nos. DPR-71 and DPR-62 o

During an NRC inspection conducted on September 13-17, 1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1993), the violation is listed below:  ;

10 CFR 55.25 states "If, during the term of the (operator's) t license, the licensee develops a physical or mental condition that '

causes the licensee to fail to meet the requirements of 5 55.21 of  :

this part, the facility licensee shall notify the Commission within  :

30 days of learning of the diagnosis. For conditions for which a conditional license (as described in S 55.33(b) of this part) is L requested, the facility licensee shall provide medical certification <

on Form NRC 396 to the Commission (as described in 5 55.23 of this ,

part)." Also, 10 CFR 50.74 states "Each (facility) licensee shall notify the Commission in accordance with 9 50.4 within 30 days of i the following in regard to a licensed operator or senior operator:  ;

...(c) Disability or illness as described in s 55.25 of this chapter."

Contrary to the above, on April 7, ~ 1989; November 28, 1990; April 25, 1991; and June 9,1992, the facility licensee's physician '

made the determination that each of four operator's eyesight no  :

longer met the minimum standards required by 55.33 (a)(1) as  ;

measured by the standards of ANSI /ANS-3.4-1983. Additionally, on  ;

April 19, 1991, the facility licensee's physician made the determination that an operator's medical condition would not permit solo operation, again as measured by the standards of ANSI /ANS-3.4-1983. Subsequently, the facility licensee, in each case, failed to notify the Commission of the change in medical status of these ,

operators within 30 days as required by 10 CFR 55.25 and  ;

10 CFR 50.74. l This is a Severity Level IV violation (Supplement VII.D) 1 Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington,' D.C.

20555 with a copy to the Regional Administrator, Region II, and a copy to the '

NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation; (1) the reason for the violation, or if contested, the basis for disputing the violation, (2) the ,

corrective steps that have been taken and the results achieved, (3) the ,

corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order or demand for- '

information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be  :

taken. Where good cause is shown, consideration will be given to extending ,

the response time.
