NOTICE OF VIOLATION Carolina Power and Light Company Docket Nos. 50-325 and 50-324 Brunswick Steam Electric Plant License Nos. DPR-71 and DPR-62 During an NRC inspection conducted on January 26-30, 1998, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions." NUREG-1600. the violation is listed below:

10 CFR 50.54(q) specifies that a licensee authorized to possess and operate a nuclear power reactor shall follow and maintain in effect emergency plans which meet the standards in 10 CFR 50.47(b) and the 1

requirements in A)pendix E to 10 CFR Part 50.~and that the licensee may make changes to t1ese plans without Commission approval only if the changes do not decrease the effectiveness of the plans and the plans, as changed, continue to meet the standards in 10 CFR 50.47(b) and the requirements in Appendix E to 10 CFR Part 50.

Section IV..F.2.b of Appendix E to 10 CFR Part 50 was revised in 1996 to allow a licensee to conduct an exercise of its onsite emergency plan every two years instead of annually, and to specify that "the licensee shall take actions necessary to ensure that adequate emergency response capabilities are maintained during the interval between biennial j

exercises by conducting drills, including at least one drill involving a combination of some of the principal functional areas of the licensee's onsite emergency response capabilities."

Contrary to the above. Revision 46 to the licensee's emergency plan j

decreased the effectiveness of the plan in that it adopted the i

regulatory provision for biennial exercises but did not address the l

requirement in Appendix E to conduct a drill between biennial exercises that would involve a combination of some of the princiaal functional areas of the licensee's onsite emergency response capa)ilities.

This is a Severity Level IV violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201. Carolina Power and Light Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Commission. ATTN:

Document Control Desk. Washington. D.C.

20555 with a copy to the Regional Administrator. Region II. and a copy to the NRC Resident Ins)ector at the Brunswick Steam Electric Plant, within 30 days of the date of tie letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested. the basis for disputing the violation. (2) the corrective steps that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full com31iance will be achieved.

Your response may reference or include 3revious docceted correspondence if the correspondence adequately addresses t1e required response.
