NOTICE OF VIOLATION Carolina Power and Light Company Docket Nos. 50-325 and 50-324 Brunswick Units 1 & 2 License Nos. DPR-71 and DPR-62 During an NRC inspection conducted from December 9-12. 1997, two violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions." NUREG-1600, the violatie.is are listed below:

A. Technical Specification 6.12. High Radiation Areas, states for each high radiation area for which the intensity of radiation is greater than 1000 mrem /hr.. that locked doors shall be provided to prevent unauthorized entry into such areas and that keys shall be maintained under the administrative control of the Radiation Control Supervisor.

Environmental and Radiation Control Procedure OE&RC-0040. " Control of Locked High Radiation And Very High Radiation Areas". Revision 15.

Effective 7/21/97. Paragraph 7.1. states "Do not leave an unsecured Locked High Radiation Area unattended. Ensure access is controlled by Radiation Control personnel or by designated personnel as allowed by this procedure or the entrances must be secured with designated special cal-core locks prior to leaving the area unguarded" Contrary to the above. on November 18, 1997, a Locked High Radiation Area was left unattended and the entrance was not secured with designated special cal-core locks prior to leaving the area unguarded.

This is a Severity Level IV Violation (Supplement I). This is applicable to both units.

B. 10 CFR 50. Appendix B. Criterion XVI, requires that measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions. deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected.

Carolina Power and Light Company Plant Program Procedure PLP-04

" Corrective Action Management". Revision 23. dated 10/27/97. implements 4 the requirements of Criterion XVI at the Brunswick Nuclear Plant.

Attachment 6 of this procedure. " Criteria for Condition Reports". states

" person does .not comply with procedure requirements" as an example of a condition that should be a Condition Report. Paragraph 6.0 of PLP-04 requires that personnel shall review their activities for adverse conditions which meet the threshold for initiating a Condition Report and, upon identifying such a condition, initiate a Condition Report.

Contrary to the above, on November 18. 1997, the licensee failed to initiate a Condition Report upon identifying a Locked High Radiation Area not properly controlled in accordance with applicable procedures.

20555 with a copy to the Regional Administrator Region II. and a copy to the NRC Resident Inspector at the Brunswick facility, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the

-basis for disputing the violation. (2) the corrective steps that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence. if the correspondence adequately addresses the required

. response. If an adequate reply is not received within the time specified in this Notice, an .,rder or a Demand for Information may be issued as tc why the license should act be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy. proprietary, or safeguards information so that it can be placed in the PDR without redaction, llowever, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR. and provide the legal basis to support your request for withholding the information from the public.
