l Carolina Power and Light Company Docket Nos. 50-325, 50-324 i Brunswick Units 1 and 2 License Nos. DPR-71, DPR-62 i During an NRC inspection conducted on February 4-8, 1991, a violation of NRC ,

requirements was identified. In accordance with the " General Statement of I l Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C j (1990), the violation is listed below:- I 10 CFR 71.5(a) requires each licenses who transfers licensed material outside of the confines of its plant or other place of use, or who delivers licensed material to a carrier for transport, shall comply with the applicable requirements of the regulations appropriate to the mode of transport of DOT in 49 CFR Parts 170 through 189.

49 CFR 173.425(b)(1) requires that packaged shipments of low specific activity (LSA) material consigned as exclusive use must be packaged in strong, tight packages so there will be no leakage of radioactive materials under conditions normally incident to transportation.

49 CFR 173.475(b) requires, before each shipment of any radioactive materials package, that the shipper shall ensure by examination or appropriate tests that the package is in unimpaired physical condition, except for superficial marks.

Paragraph III, Item J. of Appendix C, titled " Radioactive Shipment Checkoff Form for Nonburial. Shipments" of Brunswick Steam Electric Plant's Environmental and Radiation . Control Procedure: E&RC-0579 Volume VIII, Revision 004, titled " Documentation of Radioactive Shipments, requires the

-initialing or checkoff of a step verifying that the LSA shipment packaging is in unimpaired physical condition, except for superficial marks.

L Contrary to the above, on January 31, 1991, Brunswick shipped an LSA shipment in an exclusive use vehicle to an outside vendor in which one of the packages shipped had a metal fracture approximately 4 to 8 millimeters i long; thus the package was in impaired physical condition.

This is a Severity Level IV violation (Appendix C, Supplement V).
