REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, SAXTON NUCLEAR EXPERIMENTAL CORPORATION By your letter dated July 1,1992, you submitted PENLEC/GPU Internal Affairs Department Report, Williamsburg Incident Investigation 89-WM-2, originally

issued 2/7/89, and requested that it be withheld from public disclosure. This request was made pursuant to Title 10 of the Code of Federal Regulations, Section 2.790 (10 CFR 2.790) and was supported by the contention that the information contains personal information exempted from disclosure under 2.790(a)(6).

Upon careful review of your request, the Nuclear Regulatory Commission staff concluded in a letter to Mr. James Knubel dated December 11, 1992, that some of the material contained in your document may be withheld in accordance with 10 CFR 2.790(a)(6), but that certain other material should be released and placed in the Public Document Room. The report also contained what appeared to be information of the type referred to in 10 CFR 2.790(a)(4), trade secrets and commercial or financial information obtained from a person and privileged or confidential. The staff determined that this information could not be withheld under 10 CFR 2.790(a)(6) and that an affidavit in accordance with 10 CFR 2.790(b)(1) would have to be provided.

In your response of January 19, 1993, you agreed with our conclusion that revealing the identity of a number of individuals would not conrtitute a clearly unwarranted invasion of personal privacy. However, you requested that the identity of the decedent "DD" be withheld for the benefit of DD's survivors. The staff agreed in a letter dated March 5,1993, that the identity of DD constituted an instance when the right of personal privacy should continue for the benefit of DD's survivors.

In your response of January 19, 1993, you also withdrew your request for withholding from public disclosure the commercial information that th'e staff  ;

had identified on pages 119,120, and 280 of your document.

The staff determined in their letter of March 5,1993, that the submitted ,

information sought to be withheld contained personnel and medical files and similar files, the disclosure of which would constitute a clearly unwarranted ,

invasion of personal privacy and that the information agreed to by GPU Nuclear i Corporation and the NRC staff as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended. We also requested that you submit a new -

redacted version of your report that protects the information agreed to as l

proprietary.

By letters dated May 3, 1993, and May 12, 1993, you submitted a final redacted i version of your report. We have reviewed the report and find that the  ;

contents protect the information agreed to as proprietary. For your information, pages 61, 66, and 70 of the May 12, 1993 corrected redacted report were in the incorrect order.
