DECOMMISSIONING FINANCIAL ASSURANCE FOR THE SAXTON NUCLEAR EXPERIMENTAL CORPORATION FACILITY (TAC NO. MA5286)

Dear Mr. Kuehn:

By letter dated March 31,1999, GPU Nuclear, Inc., provided, in accordance with 10 CFR 50.75 (f)(1), information on the current funding status for the decommissioning funds established for the Saxtcn Nuclear Experimental Corporation (SNEC) Facility (SNEF). The report indicates that Pennsylvania collections for decommissioning the SNEF ceased j

December 31,.1998, and that New Jersey collections will continue at an annual rate of

$175,000 for an expected 6.5 years. The~ report states that any funding shortfall will be borne by the shareholders. The^ amount remaining to be collected is stated in the report as

$ 10,139,000.

By letter dated July 26,1990, the NRC was informed that the method of funding used by SNEC for the SNEF is an external sinking fund method through the use of a trust. From the information submitted on March 31',1999, it appears that sufficient deposits to the trust are no longer being made. Please provide information on how the SNEC will show compliance with the requirements in 10 CFR 50.75 on how you will provide reasonable assurance that funds will be available for the completion of the decoramissioning process.

Please provide your response within 30 days of the date of this letter. In accordance with 10 CFR 50.30(b), your response must be executed in a signed original under oath or affirmation.
