River Bend Station - Unit 1 Docket No. 50-458 In Gulf States Utilities Corporation's (GSU) application to amend the River Bend Station, Unit 1 Facility Operating License NPF-47 to request approval for Entergy Operations, Inc. (EOI) to be included as a licensee of River Bend with authority to operate the facility on behalf of its owners (RBG-37,989), dated January 13, 1993, we stated:

EOl will do no more than operate River Bend. It will not be involved in the marketing or brokering of power or energy from the facility. (Application at Page 14 of 16)

During the February 4,1993, meeting with the NRC Staff, we s'.ated, in answer to a Staff question, that GSU and EOI would accept a license condition, similar to those recently imposed by the NRC Staffin similar situations, confirming what we stated in the application in regard to the non-involvement of EOI in the marketing or brokering of power or energy.

Subsequently. the NRC Staff requested that GSU and EOI supply the language of an i acceptable license condition. Accordingly, we have set forth below the text of such a license condition modeled after the ANO-2 and Farley examples:

a. GSU shall comply with the antitrust license l conditions set forth in Appendix C, attached hereto  !

i and incorporated in this license.  !

l l b. EOl shall not market or broker power or energy l from River Bend Station, Unit 1. GSU is i responsible and accountable for the actions of its 3

agent, EOI, to the extent said agent's actions affect the marketing or brokering of power or energy from River Bend Station, Unit 1 and, in any way, I

contravene the antitrust conditions of this paragraph j or Appendix C of this license.  !

l EOI has reviewed this proposed condition and has authorized us to state that it does not i object to its inclusion in the license at the same time that the NRC approves the addition of EOI

! to the license as operator of River Bend. Should you require any further information, do not j hesitate to contact us.
