NOTICE OF VIOj.ATION Commomwealth Edison Company Docket No. 50-456 Docket No. 50-457 As a result of the inspection conducted on November 26-December 3,1990, and in ectordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1989), the following violation was identified:

Techr,ical Specification 3.12.1.b requires that when the level of radioactivity as the result of plant effluents in an environmental sempling medium at a specified location exceeds the reporting levels of Table 3.12-2 when averaged over any calendar quarter, the licensee must prepare and submit to the Commission within 30 days pursuant to Specification 6.9.2, a Special Report that identifies the cause(s) for exceeding the limit and defines the corrective actions to be taken to reduce radioactive effluents...

Contrary to the above, the licencee foiled to submit to the Commission a Special Report within the 30-day time frame af ter finding that in the third quarter of 1989, a surface water sample from the Kankakee River had a tritium concentration of 38,670 pCi per liter, a value that exceeded the reporting levels in Table 3.12-2 for H-3 of 30,000 pCi per liter (nondrinking water pathway).

This is a Severity Level IV violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are requested to submit to this office within thirty days of the date of this notice a written statement or explanation in reply:

(1) corrective actions that have been taken and the results achieved; (2) the corrective actions that will be taken to avoid

.further violations; and (23) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause.
