NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos.. 50-456; 50-457 Braidwood Nuclear Station Licenses No. NPF-72; NPF-77' During an NRC inspection conducted on March 11-22, 1991, a violation of NRC 4

requirements was identified.

in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, (1991), the violation is listed below:

10 CFR 71.5 requires, in part,.that each licensee who delivers licensed material to a carrier for transport comply with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.

49 CFR 173.475(i) states that before each shipment of any radioactive materials package, the shipper shall ensure by examination or appropriate tests that external radiation and contamination levels are within the allowable limits specified in this subchapter.

Contrary to the above, on February 18, 1991, the licensee delivered licensed material to a carrier for transport and did not ensure by examination or appropriate tests that external radiation and contamination levels were within the allowable limits. Specifically, a box of contaminated protective clothing.

containing approximately 33 millicuries of iron-55, cobalt-58, nickel-63, cobalt-60, manganese-54, chromium-51, niobium-95, and iron-59, was shipped from Braidwood and no survey was performed prior to the shipment.

With respect to the violation, the inspection showed that actions had been l

taken to correct the identified violation and to prevent recurrence.

Consequently, no reply-to the violation is required and we have no further questions regarding-this matter.
