OF CONFERENCE CALL PUBLIC MEETING HELD ON JUNE 24, 2014, WITH OMAHA PUBLIC POWER DISTRICT TO DISCUSS PROPOSED REVISION TO TECHNICAL SPECIFICATION SECTIONS 2.0.1 AND 2.7 FOR FORT CALHOUN STATION, UNIT 1 (TAC NO. MF0691)

On June 24, 2014, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Omaha Public Power District (OPPD) by teleconference at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss the license amendment request (LAR) submitted by OPPD for Fort Calhoun Station (FCS), Unit 1 on February 18, 2013, as supplemented by letter dated February 20, 2014 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML13051A741 and ML14052A204, respectively),

regarding OPPD's proposed revision to the Technical Specifications (TSs) for operability of electrical power systems during shutdown. A list of attendees is provided in the Enclosure. The meeting notice and agenda is available at ADAMS Accession No. ML14163A118.

Background

By letter dated March 14, 2010, the NRC issued Amendment No. 264 (ADAMS Accession No. ML100910077) that changed the TS sections 2.0.1 and 2.7 and deleted Surveillance Requirement 3.7(1)e. Specifically, Amendment No. 264 revised the definition for "Operable-Operability" and modified the provisions under which equipment may be considered operable when either its normal or emergency power source is inoperable. Amendment No. 264 had an unintended consequence that inadvertently changed the requirement for operable emergency power sources when the reactor coolant temperatures are less than 300 degrees Fahrenheit (°F).

To correct the inadvertent change, OPPD submitted an LAR dated February 18, 2013, as supplemented by letter dated February 20, 2014, to address the problem by changing the definition of "Operable- Operability" back to the pre-Amendment No. 264 definition, and relocating information in TS 2.7, Electrical Systems, toTS 2.0.1 (2), General Requirements for Limiting Conditions for Operation. However, the NRC staff understands the addition of TS 2.0.1 (2) allows components without a normal or emergency power source to be considered operable when reactor coolant temperature is less than 300 °F. Prior to Amendment No. 264, TS 2.0.1 (2) did not contain the explicit statement" ... the reactor coolant temperature is

> 300 [degrees] F ... " as it did in the February 18, 2013, submittal. During the review of this LAR, NRC had several concerns about the safety justification for the relaxation of the electrical power operability requirements when the reactor coolant temperature is less than 300 °F. In an effort to address these concerns further with the licensee, NRC held a public meeting via teleconference with OPPD.

Meeting Summary During the public meeting, the NRC staff and OPPD discussed the proposed LAR focusing on the operability of electrical power systems during shutdown conditions. There was a disagreement on the interpretation of the operability of diesel generators at reactor coolant temperatures less than 300 oF prior to Amendment No. 264. As indicated in request for additional information (RAI) responses dated February 20, 2014, OPPD understands emergency power is not required forTS operability and electrical power for shutdown operation is controlled by plant procedures because FCS was not designed or licensed to General Design Criterion 34 on loss of residual heat removal. However, it is the NRC staffs understanding that prior to Amendment No. 264, the TSs required at least one train of emergency power to be operable in shutdown conditions because the definition of operable included the statement "Implicit in this definition shall be the assumption that all necessary attendant instrumentation, controls, normal and emergency electrical power sources, ... are also capable of performing their related support function(s)."

OPPD recognizes NRC representatives' concerns, but is unable to make a commitment regarding the issue before discussing with OPPD management. As a result of the meeting, OPPD agreed to discuss NRC staff's concerns with OPPD management and determine its next action. Subsequent to the public meeting, OPPD withdrew this LAR by letter dated July 15, 2014 (ADAMS Accession No. ML14198A397).

While this was a Category 1 public meeting, no members of the public were in attendance. No Public Meeting Feedback Forms were received for this meeting.
