By letter dated January 14, 2010, Entergy Operations, Inc. (Entergy, the licensee) submitted, in accordance with the requirements of 10 CFR 73.5, a request to the U.S. Nuclear Regulatory Commission (NRC) for approval of an exemption from specific requirements of 10 CFR Part 73, "Physical Protection of Plants and Materials," for Arkansas Nuclear One, Units 1 and 2 (ANO-1 and 2). The requested exemption extends the compliance date for the implementation of certain new security requirements issued by NRC in a final rule dated March 27, 2009 (74 FR 13926).

Pursuant to the final rule, the new security requirements must be implemented by March 31, 2010. Entergy has evaluated these new requirements and determined that the majority can be implemented by the March 31, 2010, compliance date. The attachment to the letter dated January 14, 2010, provides additional details regarding the specific provisions of the rule for which an exemption is requested, as well as an environmental assessment.

On January 21, 2010, the NRC staff discussed with the Entergy staff (Natalie Mosher, Tony Qualantone, Ken Vess, Ken Jeffery, and David Bice) certain aspects of the Exemption Request which needed additional clarification. The Entergy staff, stated the requested clarification would be provided on the docket soon, in keeping with the requested approval date of the exemption.

The purpose of this letter is to provide the results of the NRC staff's acceptance review of this exemption request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and the anticipated supplement (in response to the call with your staff on January 21, 2010), concluded that adequate technical information, in sufficient detail, will be available to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the exemption request, in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
