By letter dated June 8, 2009, Entergy Operations, Inc. (Entergy) submitted, pursuant to 10 CFR 50.55a(a)(3)(i), a request for alternative to the requirements of 10 CFR 50.55a(g)(4)(ii) pertaining to the 10-year update of the Arkansas Nuclear One, Unit 2 (ANO-2) Inservice Inspection (ISI) program to the 2004 Edition of the American Society of Mechanical Engineers (ASME), Boiler and Pressure Vessel Code,Section XI.

Entergy is required to update the ANO-2 120-month ISI Program to the latest Edition and Addenda of the ASME B&PV Code,Section XI, approved by the NRC in 10 CFR 50.55a(b)(2), for the fourth interval.

However, with the approval of this request, all the Entergy South units ISI programs will be based on the same version of the ASME Code (2001 Edition with the 2003 Addenda), which will allow Entergy to return to one standard process. Entergy believes this standard process improves the quality of the ISI programs at each of the Entergy South units.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this relief request.

The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Pursuant to Sections 50.55a(a)(3)(i) of Title 10 of the Code of Federal Regulations (10 CFR), the applicant shall demonstrate that the proposed alternatives would provide an acceptable level of quality and safety. The NRC staff has reviewed your application and concludes that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the request for alternative in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
