By letter dated February 17, 2010, Entergy Operations, Inc. (Entergy), submitted a relief request, pursuant to 10 CFR 50.55a(a)(3)(i), for the Arkansas Nuclear One, Unit 2 (ANO-2)

Fourth 10-Year Interval Inservice Testing Program for the Service Water pumps. The proposed relief is requested when using the requirements of American Society of Mechanical Engineers (ASME) Operation and Maintenance (OM) Code, 2004 Edition, pertaining to an inservice test that requires the pump flow rate and differential pressure be evaluated against reference values to monitor pump condition and to allow detection of hydraulic degradation. The proposed relief is in accordance with ASME Code Case OMN-16.

The relief request is PRR-ANO2-2010-1 and is covered by TAC Nos. ME3367.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the Relief Request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Pursuant to 50.55a, of Title 10 of the Code of Federal Regulations (10 CFR), the Commission will evaluate determinations where Code requirements are impractical. The Commission may grant such relief and may impose such alternative requirements as it determines is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the facility.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed Request for Alternative in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
