Monticello EPU amendment - Draft technical position on NSPM's 7/13/09 response (TAC MD9990)

By letter dated July 13, 2009, NSPM responded to Question 38, among other things, of the NRC staff's RAIs regarding the containment system. NSPM stated that the associated circuits analyses conducted previous to 2004 did not include a loss of containment overpressure. The response stated that this finding was entered into the Monticello corrective action program for evaluation at CLTP and EPU conditions. The NRC staff does not find this approach acceptable. Since use of containment accident pressure is predicated upon containment integrity, this issue needs to be resolved as a regulatory issue prior to approval of the EPU amendment.
