50-296 BROWNS FERRY NUCLEAR PLANT (BFN) - UNITS 1, 2, AND 3 - TECHNICAL SPECIFICATIONS (TS) CHANGES TS-431 AND TS-418 - EXTENDED POWER UPRATE (EPU) - DRAFT ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT (TAC NOS. MC3812, MC3743, AND MC3744)

By letters dated June 28, 2004 and June 25, 2004 (ADAMS Accession Nos. ML041840109 and ML041840301, respectively), TVA submitted license applications to the NRC for the EPU of BFN Unit 1 and BFN Units 2 and 3, respectively.

The NRC prepared, and published in the Federal Register on November 6, 2006 (71 FR 65009), a draft Environmental Assessment and Finding of No Significant Impact (hereinafter, draft EA) regarding proposed license amendments to increase the maximum power levels of BFN Units 1, 2, and 3 to 3952 MWt.

Based on its review, the NRC concludes that the proposed action would not have a significant environmental impact. The accompanying Federal Register Notice provided for a 30-day public comment period.

TVA concurs with the NRCs assessment and conclusion associated with the EPU license amendments as documented in the draft EA with the following minor comment. Under the section, Non-Radiological Impacts, and subheading, Discharge Impacts,

U.S. Nuclear Regulatory Commission Page 2 December 5, 2006 there is a statement that an [i]ncrease in discharge temperature beyond the NPDES limits would trigger operation of the cooling towers in helper mode. Under virtually any circumstance, TVA would take action to ensure that the discharge temperature did not go beyond the NPDES limits.

The sentence should be revised to state an [i]ncrease in discharge temperature approaching the NPDES limits would trigger operation of the cooling towers in helper mode.

TVA would operate the cooling towers to maintain compliance with NPDES permit thermal requirements.

No new regulatory commitments are made in this submittal.
