EXTENSION OF STAFF REVIEW SCHEDULE FOR NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2, AMENDED LICENSE RENEWAL APPLICATION (TAC NOS. MC3272, MC3273, MC3274, AND MC3275)

Dear Mr. Spina:

On May 27, 2004, the U.S. Nuclear Regulatory Commission (NRC or the staff) received the Constellation Energy application for renewal of Operating Licenses DPR-63 and NFP-69 for the Nine Mile Point (NMP) Nuclear Station, Units 1 and 2, respectively. Notice of Acceptance for Docketing of the Application and Notice of Opportunity for Hearing regarding this application was published in the Federal Register on July 21, 2004, (69 FR 43631). By letter dated December 7, 2004, the NRC staff informed you of our concern regarding NMPs inadequate support of the license renewal activities, and this concern was highlighted by the staff audits and your responses to the staffs requests for additional information (RAIs). By letter dated January 3, 2005, you informed the staff that you had taken actions to resolve the factors contributing to your past performance and committed to provide the necessary support for the license renewal process. On March 3, 2005, you requested a grace period to recover the quality of your License Renewal Application (LRA). On May 13, 2005, you notified the staff that the amended NMP LRA would be sent by July 15, 2005. By letter dated July 14, 2005, you submitted the NMP amended LRA for Units 1 and 2, and requested that the staff resume its review of your application for renewal of the NMP Operating Licenses.

The staff has resumed its review as requested. However, as a result of your earlier inadequate support of the LRA review activities and your request for a grace period, we agree that the standard review schedule will be extended.

Please find enclosed the revised staff safety and environmental review schedule for the subject application. The staff will follow established review procedures and the enclosed schedule to complete the safety and environmental reviews pursuant to 10 CFR Parts 54 and 51.
