SAFETY EVALUATION REPORT FOR THE NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION (TAC NOS. MC3272 AND MC3273)

Dear Mr. OConnor:

By letter dated May 26, 2004, Constellation Energy Group, LLC (CEG or the applicant) submitted an application to the U.S. Nuclear Regulatory Commission (NRC or the staff) for the renewal of the Nine Mile Point Nuclear Station (NMPNS), Units 1 and 2, operating licenses for up to an additional 20 years. The license renewal application (LRA) was submitted pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The NRC staff determined that the LRA was complete and acceptable for docketing on July 15, 2004. Subsequently; as a result of issues identified during the staffs review and audits of your LRA, on July 14, 2005, you submitted the amended LRA (ALRA).

The NRC staff has reviewed the NMPNS Units 1 and 2 LRA and amended LRA (ALRA) and has developed the enclosed Safety Evaluation Report related to the License Renewal of the Nine Mile Point Nuclear Station, Units 1 and 2, hereinafter referred to as the Safety Evaluation Report (SER). This SER reflects the status of the staffs review of the LRA and ALRA, requests for additional information (RAIs), applicants responses to the staffs RAIs and other questions related to the LRA and ALRA through December 13, 2005, unless otherwise noted. Issuance of the enclosed SER is an important milestone for both the applicant and the staff.

The NRC staff has identified one open item in its review that must be resolved before a final determination can be taken. The open item is summarized in Section 1.5 of the SER. In order to close this item, the staff has requested additional information, as identified in the SER.

In accordance with the schedule for completing the review of the LRA and ALRA, the applicant is requested to review the enclosed SER, verify its accuracy, and provide comments to the NRC staff by April 3, 2006. The NRC staff plans to review the current content and format of the SER for further improvement while incorporating the applicants comments. A complete and revised SER will then be issued by June 1, 2006.
