Gentlemen:

By letter dated March 3, 2005, Nine Mile Point Nuclear Station, LLC (NMPNS) requested a grace period to recover the quality of the License Renewal Application (LRA) for Nine Mile Point (NMP) Units 1 and 2.

In a response letter dated March 7, 2005, the NRC acknowledged receipt of this request and informed NMPNS that: (1) the review of the NMP LRA had been stopped, and (2) the standard 22-month review schedule would not be met due to the delay caused by the recovery period. The NRC also stated that the staff would resume their review and audits upon receipt of the NMPNS submittal confirming the completion of the recovery efforts. In subsequent discussions, the staff requested notification sixty (60) days prior to the NMP LRA re-submittal.

This letter constitutes the sixty (60) day notification agreed upon with the staff. It is our intent to complete the recovery tasks associated with the quality upgrade of our application in sufficient time to re-submit the NMP LRA on July 15, 2005.
