OF A CONFERENCE CALL HELD ON JANUARY 28, 2005, BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND THE CONSTELLATION ENERGY GROUP INC. CONCERNING THE REVIEW FOR THE NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION (TAC NOS. MC3272 AND MC3273)
The U.S. Nuclear Regulatory Commission staff and representatives of Constellation Energy Group Inc. (CEG or the applicant) held a conference call on January 28, 2005, to discuss questions pertaining to the Nine Mile Point Nuclear Station, Units 1 and 2 (NMP) license renewal application (LRA).
The conference call was useful in further clarifying the intent of the staffs followup questions to the applicant supplement dated November 19, 2004 (ADAMS ML043360053) and supplement dated December 6, 2004 (ADAMS ML043490370). On the basis of the discussion, the applicant was able to better understand the staffs questions. No staff decisions were made during the meeting, and the applicant agreed to provide information for clarification in their final responses. provides a list of the meeting participants. Enclosure 2 contains a listing of the staffs followup questions and the applicants corresponding proposed responses which were used as discussion material during the telephone conference.

The staff held a telephone conference with the applicant on January 27, 2005, to discussion the staffs Followup Items questions. Followup Item 3.1.1.A-08 of Table 3.1 Item 3.1.1.A-08 page 3.1-23 of NMPs Supplement letter dated December 6,2004, stated that the vessel flange leak detection (VFLD) lines for NMP1 are not within scope of license renewal.
However, LRA Table 2.3.1.A.1-1 listed flange leak detection lines in scope. of NMPs Supplement letter dated November 19, 2004,November 19, 2004, stated that the classification of the NMP1 reactor vessel VFLD line will be re-evaluated, and an AMP be identified as appropriate by May 31,2005.
In AMR Audit item 226, NMP stated that the component is tested by the ISI pressure test since it is essentially a small-bore pipe. At NMP1, it will be part of the One-time inspection program too, since the component is subject to SCC.
Staffs Comment: Please verify if NMP1 VFLD line is in scope or not. Also the scheduled date of May 31, 2005, for providing this information to the staff is VERY untimely to support the staff review.
Proposed Draft Response from the Applicant: The NMP1 VFLD line is not in scope for license renewal since it is non-safety related (NSR) and does not contain a liquid such that it meets the criteria for inclusion under (a)(2). This line is NSR since it does not meet any of the criteria of RG 1.26 for being safety related (i.e. part of reactor coolant pressure boundary (RCPB), needed to safely shutdown the reactor, or prevent radiological releases). The line is not considered part of the RCPB since the boundary ends at the reactor vessel flange. The VFLD line also does not contain any liquid during plant operation. Therefore, there is no liquid to leak onto SR equipment should a failure be postulated. Based on the above, the NMP1 VFLD line is not considered in-scope for license renewal. NMP recognizes that LRA Table 2.3.1.A.1-1 is in error and should have been corrected in our 11/19/04 letter. The LRA will be revised to remove the VFLD line from this table in a new letter.

Followup Item 3.1.1.A-27 of Table 3.1 Item 3.1.1.A-27 page 3.1-26 of NMPs Supplement letter dated December 6, 2004, states that NMP1 credited ASME Section XI ISI program to manage aging effects. In its 12/6/04 supplement, the applicant states that for Nozzles component type (under Item 3.1.1.A-27, on page 3.1-42), NMP1 credited BWR Control Rod Drive Return Line (CRDRL) Nozzle Program as the aging management program (AMP) to manage its cracking aging effect.
Staffs Comment: Please clarify the above discrepancy in AMP for CRDRL Proposed Draft Response from the Applicant: The CRD Return Line is inspected under the applicants ISI plan which includes each of the attributes of the BWR CRD Return Line Program.
The applicant stated that the last sentence of the Discussion column for item 3.1.1.A-27 was an attempt to clarify why the line item in the Table 2 credits the BWR CRD Return Line Program and that NMP does not have a program titled as such in Appendix A or B. NMP will clarify it further or provide different wording.
