Gentlemen:

By letter dated December 7, 2004, the NRC informed Nine Mile Point Nuclear Station, LLC (NMPNS) of a concern relating to support of activities required to maintain the established review'schedule for the Nine Mile Point'(NMP) License Renewal Application (LRA). The letter identifies past performance in which the NMPNS. support for NRC audit activities and responses to draft requests for additional informationj did not meet the NRC's expectations.. The NMPNS plan to provide adequate resources to support the established review schedule wvas also requested.

NMPNS and Constellation Energy are committed to providing the necessary resources to meet the established schedule for the review of the NMP LRA. The renewal of the operating licenses for NMP Units I and 2 is a strategic part of our company's future plans and of utmost importance to the company. Itis rec6gnizid, -however, that our past performance did not always meet your expectations or our expectations for responsiveness. While there are several contributing factors, we have taken-actioi t'o resolve each.factor and provide the necessary support for the remainder of the NRC review and approval schedule. Specifically, we have reorganized the project team to be more efficient, added a supervisor experienced in license renewal to oversee the corporate and site resources, added technical staff members experienced in license renewal, and assigned a Constellation Energy manager experienced in license renewal at another Constellation plant (i.e., R. E. Ginna Nuclear Power Plant) to provide consultation to the project team and improve our communications with the NRC project manager. The senior Constellation Energy project sponsor willalso provide additional oversight to ensure that any potential concerns are resolved before there isany impact to the review schedule.
