REQUESTS FOR ADDITIONAL INFORMATION FOR THE REVIEW OF NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION (TAC NOS. MC3272 AND MC3273)

Dear Mr. Spina:

By letter dated May 26, 2004, Constellation Energy Group Inc., submitted an application pursuant to Title 10 of the Code of Federal Regulations Part 54 (10 CFR Part 54), to renew the operating licenses for the Nine Mile Point Nuclear Station (NMP), Units 1 and 2, for review by the U.S. Nuclear Regulatory Commission (NRC). The NRC staff is reviewing the information contained in the license renewal application (LRA) and by letter dated November 02, 2004, the staff requested for additional information (RAIs). By letter dated December 22, 2004, you provided your responses to the staffs RAIs. The staff has reviewed the responses and has identified, in the enclosure, areas where followup information is needed to complete the review.

Based on discussions with Mr. Peter Mazzaferro of your staff, a mutually agreeable date for your response is within 30 days from the date of this letter. LRA Section 2.0, Scoping And Screening Methodology On December 22, 2004, NMP provided its responses (NMP1L 1904) to the staff RAIs regarding LRA Section 2.0, Scoping And Screening Methodology For Identifying Structures And Components Subject To Aging Management Review, And Implementation Results The following is the staff followup question and this question has been discussed with the NMP staff at the NRC/Constellation LLC public meeting on February 2, 2005:

RAI 2.1-4 (Followup Item 2.1-4) - The staff requested the applicant review their 10 CFR 54.21(a)(2) evaluation to verify that the equivalent anchors and equipment within the anchor boundaries were included within scope. Specifically, with respect to NMP responses to RAI 2.1-4(a), the staff requested the applicant to verify that for systems which use plant equipment as the equivalent anchors, the equipment was included in scope. Additionally, for systems that are already in scope but which transition outside of the safety-related buildings, the staff requested the applicant to verify that equivalent anchor was also included in those cased where the equivalent anchor was located beyond the building boundary. For both cases the staff requested the applicant to document their scoping evaluations that were used to verify these conditions.

The staff requested the applicant to provide additional information to NMP response to RAI 2.1-4(b) and identify how many non safety-related (NSR) components were excluded from scope based on the use of the NSR Safety Systems and Components (SSCs) which Functionally Interact With SR SSCs' criterion. The staff requested the applicant to confirm that the criterion was not used to exclude any NSR SSCs that could inhibit a SR SSC from performing its intended functions.
