Gentlemen:

By letter dated March 3, 2005, Nine Mile Point Nuclear Station, LLC (NMPNS) requested a grace period to recover the quality of the License Renewal Application (LRA) for Nine Mile Point (NMP) Units 1 and 2. This action temporarily suspended the formal review of the LRA.

In a letter dated March 7, 2005, the NRC acknowledged receipt of this request and informed NMPNS that: (1) the review of the NMP LRA had been suspended; and, (2) the standard 22 month review schedule would not be met due to the suspended review period.

In subsequent communications, the NRC requested formal notification 60 days prior to the date when an amended LRA incorporating the Requests for Additional Information (RAIs) to-date would be sent. In a letter dated May 13, 2005, NMPNS provided notification that the amended LRA would be sent by July 15, 2005. This letter transmits the NMP amended LRA.

Our recovery plan was designed to perform the comprehensive review that the NRC staff noted in their March 7, 2005 letter. In addition, the plan also addressed the full spectrum of issues that had been communicated previously by the staff as well as a number of self-identified areas for enhancement. All elements of our recovery plan have been completed, and the results that effected changes to the LRA have been incorporated into the amended application.

This is not a new or revised application, but rather an enhancement to the original LRA submitted by letter NMP IL 1829, dated May 26, 2004. The amended application remains compatible with NRC license renewal guidance documents and has a more refined level of detail

Page 2 NMP1L 1962 that should facilitate the NRC staff review. To further support this review, a second version of the amended LRA is provided with comment notations and other editing features incorporated to highlight specific changes. These features provide a "road map" of the enhancements and this methodology was explained to the staff in our meeting on June 9, 2005.

While the amended LRA includes all applicable RAI results, the detailed responses to each RAI are being sent under separate cover. Two RAI response letters have been generated for: (1) responses to previously unanswered RAIs; and, (2) responses to previously answered RAIs that were revised due to the results of our recovery program. These letters are being sent separately.

Consistent with our continuing discussions, we request that the temporary suspension of the NMP LRA review be lifted and the formal NRC review efforts recommence at the earliest time practicable. In making this request, we recognize that the staff has ongoing obligations to other applicants, and we acknowledge that our request to suspend the LRA review activities may have affected the normal review schedule established for the NMP application.

The commitments associated with the information contained in this submittal have been incorporated into the amended LRA and summarized in Appendix A thereof Enclosure I provides a paper copy of the amended LRA (not including the Environmental Report). Enclosure 2 provides a paper copy of the amended LRA with the "road map" features (not including the Environmental Report). Enclosure 3 contains a compact disc (CD) copy of the amended LRA, to facilitate entry into the NRC's Agency Document Access and Management System (ADAMS). Enclosure 4 contains a CD copy of the amended LRA suitable for posting on the NRC website. The Environmental Report has not changed as a result of the recovery project activities.

NMPNS is also providing separately 80 additional "Information Only" CD copies of the amended LRA to facilitate the NRC review of the application. These CDs are formatted in a manner that is consistent with the guidance provided in NRC Regulatory Information Summary (RIS) 2001-05, "Guidance on Submitting Documents to the NRC by Electronic Information Exchange or on CD-ROM." The CDs contain hyperlinks within the amended LRA to the Nine Mile Point Unit 1 Updated Final Safety Analysis Report, and the Nine Mile Point Unit 2 Updated Safety Analysis Report. Hyperlinks are provided to the license renewal boundary drawings for those systems that were in the original LRA. For systems that were added as a result of the re-scoping effort, drawings are being provided under separate cover and hyperlinks are not included. All boundary drawings are included as an aid in the review of the amended LRA, and should not be considered part of the amended application.
