MIDCYCLE PERFORMANCE REVIEW AND INSPECTION PLAN - DIABLO CANYON

Dear Mr. Rueger:

On August 6, 2003, the NRC staff completed its midcycle plant performance assessment of Diablo Canyon. The midcycle review for Diablo Canyon involved the participation of all technical divisions in evaluating performance indicators (PIs) for the most recent quarter and inspection results from January 1 through June 30, 2003. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility so that you will have an opportunity to prepare for these inspections and to inform us of any planned inspections that may conflict with your plant activities.

Plant performance for the most recent quarter was within the Licensee Response Column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). Therefore, we plan to conduct baseline inspections and Temporary Instruction 2515/150, Reactor Pressure Vessel Head and Vessel Head Penetration Nozzles, at your facility through September 30, 2004.

Additionally, the staff has identified a substantive crosscutting issue in the area of human performance. The human performance issues contributed to a number of green findings identified in the initiating events, mitigating systems, barrier integrity, and occupational radiation safety cornerstones. The findings included activities performed by operations and maintenance personnel. The majority of the errors involved instances of failing to ensure procedure quality or failing to follow procedures. In the initiating events cornerstone, two of the human performance issues resulted in plant transients. In one instance, maintenance personnel failed to verify previous wiring changes and the function of the circuit prior to lifting leads associated with turbine first stage pressure that resulted in inward control rod motion. In a second instance, a pressurizer power-operated relief valve opened, during power operations, when a surveillance test was performed using an incorrect revision of a procedure.

Other human performance deficiencies involved control of activities performed during the Unit 2 refueling outage. There were findings in the initiating events, mitigating systems, barrier integrity and occupational radiation protection cornerstones. Three of the findings were identified during midloop or reduced inventory operation. Specifically, a shift foreman was not

Pacific Gas and Electric Company promptly notified when containment closure could not be attained, the impact on midloop vessel level indication from filling the pressurizer relief tank was not considered, and work was performed around a startup transformer, the single source of offsite power, without notifying the shift foreman. In a separate instance, the reactor coolant system low temperature overpressure protection was inappropriately defeated and an auxiliary feedwater check valve was improperly installed. Lastly, a finding was identified when maintenance personnel did not contact radiation protection personnel prior to working in an overhead area.

The NRC will monitor your efforts to address this issue. Our monitoring efforts will be accomplished during the conduct of the routine baseline inspection program, including a problem identification and resolution inspection in June 2004.

The enclosed inspection plan details the inspections scheduled through September 30, 2004.

The inspection plan is provided to minimize the resource impact on your staff and to allow for scheduling conflicts and personnel availability to be resolved in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature.

The inspections in the last 6 months of the inspection plan are tentative and may be revised at the end-of-cycle review meeting.

In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
