Dear Mr. Chairman:

This letter forwards the final set of documents in response to your letter dated May 24, 2002, which requested records related to the reactor pressure vessel head degradation at the Davis-Besse Nuclear Power Station. The Nuclear Regulatory Commission (NRC) previously provided three sets of records to your office with my letters dated June 14, July 1, and July 9, 2002.

The enclosed records, like those previously sent, were identified as a result of a careful and extensive search by agency staff. The records include internal NRC notes, memoranda and e-mail, correspondence with the Davis-Besse licensee, communications with the nuclear industry, and non-textual material (such as photographs, compact discs, and video tapes). All are related to the agency's oversight of the Davis-Besse licensee and our response to the technical issues related to the facility's degraded reactor pressure vessel head.

Please note that some of these records are not currently available to the public because they are pre-decisional, intra-agency memoranda or because they contain allegation files, proprietary information, or government contract related information. The unauthorized release of proprietary information in particular could result in sanctions under the Trade Secrets Act. Also included are records from our allegation management system which may contain information that could identify an alleger. NRC's policy is to take all reasonable efforts not to disclose the identity of an alleger, and we request your help in preserving the confidentiality of this information. Non-public documents are marked as such, and I request that you restrict access to this information to Members and staff of the Committee. The NRC may make some of these documents available to the public in response to a pending request under the Freedom of Information Act (FOIA). We will inform you if the status of any of these currently non-public documents changes as a result of the FOIA review.
