Dear Mr. Chairman:

I am responding to your March 9, 2007, letter in which you requested that the U.S. Nuclear Regulatory Commission (NRC) brief the subcommittee on a request from FirstEnergy Nuclear Operating Company (FENOC). This FENOC request sought relaxation from the remaining two years of annual independent assessments of Operations performance at the Davis-Besse Nuclear Power Plant that were required by an NRC Order.

Subsequently, FENOC withdrew this request. In its letter of withdrawal, FENOC indicated that they see value in the continuance of the independent assessments as the assessments provide external perspectives that will further assist Davis-Besse in achieving top industry performance.

A copy of FENOCs withdrawal letter was forwarded by the NRCs Office of Congressional Affairs (OCA) to your office.

As you requested in your letter, the OCA staff contacted the subcommittees staff director, Mr. Jaron Bourke. OCA looks forward to working with him to schedule a briefing on NRCs current work if that would be helpful to you and your colleagues.
