Reference 1 provided the FirstEnergy Nuclear Operating Company (FENOC) License Renewal Application for the Beaver Valley Power Station (BVPS). Reference 2 provided a summary of a conference call between the U.S. Nuclear Regulatory Commission (NRC) and FENOC on the topic of license renewal major refurbishment and the associated environmental impacts. Reference 3 requested additional information regarding refurbishment impacts described in Appendix E, "Environmental Report," of the BVPS License Renewal Application. Reference 4 provided the FENOC reply to the NRC request for additional information.

A telephone conference call was held between the NRC and FENOC on May 20, 2008, to discuss the FENOC reply provided in Reference 4 specific to dredging performed in the BVPS barge slip in support of the Unit 1 steam generator replacement project. The NRC requested copies of the documents cited during the call. The Enclosure contains the requested documents.

Dear Mr. Urban:

To follow-up on my recent voicemail and e-Mail messages to you, I have enclosed the package of information I sent to Mr. Chris Kriley of the Pennsylvania Department of Environmental Protection (DEP) regarding FENOC's request to conduct maintenance dredging beyond the area currently permitted. The package describes our request, the need; and the expectation that the activity will not challenge the Ohio River aquatic ecology in the target area. I have also included your copy of our 2004 Annual Environmental Operating Report, Non-Radiological, which contains the data and results for the 2004 and historical Aquatic Monitoring Program activities.

Our conclusion that the dredging project will not harm the environment is based in large part upon the Aquatic Monitoring Program. The data continue to indicate that construction and operation of Beaver Valley Power Station (BVPS), beginning in the early 1970s and including construction and maintenance dredging, has not indicated any measurable negative impacts to the environment. Of specific interest to this dredging project, the data indicates normal fish and benthic communities in the New Cumberland Pool of the Ohio River on which BVPS is located.

Note too that BVPS has proactively initiated annual Pennsylvania Natural Diversity Index (PNDI) searches for the last several years in order to identify potential issues related to small and large projects. Our most recent search, for which your office should have a record, was conducted in June 2004. Our commitment tracking system indicates we are scheduled to perform that search again in June of 2005.

Enclosed, please find a copy of the above-referenced permits that authorized the construction and maintenance of a barge loading slip at the Beaver Valley Power Station (BVPS), owned and operated by FirstEnergy Nuclear Operating Company (FENOC). Maintenance dredging, 50 feet beyond the area originally authorized, is required at this slip in September of this year. Therefore, FENOC is requesting an amendment or modification to the permit.

The dredging is required to support the receipt of replacement plant components for our Unit I nuclear reactor system. The project will help ensure the continued safe and reliable operation of our plant, and the dredging will provide for safe access from the Ohio River and proper mooring of the barge. In addition to copies of the permits, the enclosure also contains a description of the project with the details of the activity that require the permit amendment, a USGS map copy, photos and a revised drawing.

FENOC does not believe the requested action will negatively impact the environment This is based in part on data from our annual aquatic monitoring program conducted since 1974, that continues to indicate that no negative impacts have been identified from the construction or operation of BVPS. Please note that we include the PA Department of Environmental Protection and the PA Fish & Boat Commission on distribution of the report.

Based on our recent conversations, I understand that a permit amendment may be an appropriate course of action to accomplish the project as described and to authorize the continued maintenance of the barge slip in the future.

Beaver Valley Power Station PROJECT DESCRIPTION Overview The purpose for the maintenance dredging is to support the project to replace our Unit 1 reactor vessel head and three steam generators, by providing full function of the barge slip for the safe receipt and unloading of these new replacement components. These large components were fabricated in Spain and will be shipped overseas to New Orleans, Louisiana. From New Orleans they will travel by barge via the Mississippi and Ohio Rivers to Beaver Valley Power Station (BVPS) in Shippingport, Pennsylvania.

These components comprise four of the five major parts of the nuclear reactor coolant and steam generation system for Beaver Valley Power Station, Unit 1 The project to replace the old equipment with these new components is part of FENOC's commitment to ensure continued safe and reliable nuclear generation of electricity for our Pennsylvania, Ohio, and New Jersey service area. Each Generator weighs 400 tons and the reactor vessel head weighs 80 tons. A single barge will make delivery to Shippingport, PA (Ohio River New Cumberland Pool) in October, 2005. Our plan is to ground the barge to insure a stable platform for offloading.

The dredging is expected to remove an estimated 3,000 cubic yards of material based on barge slip area soundings (Bathymetric Survey) taken during the Summer of 2004. The maintenance dredging operations will be performed by River Salvage of Crescent, Pennsylvania under contract with FENOC. Disposal of the dredged materialswill be in accordance with the applicable dredging and fill regulations.

Impacts FENOC does not expect negative impacts to public health, safety, or the environment from the dredging activity. The impacted area is small and prior experience with dredging activities at various points along the site, including construction and maintenance of this barge slip, have been completed without incident. Results of our 2004 aquatic monitoring program, the 2 9 th consecutive year for the program, indicated that the area of the New Cumberland Pool on which BVPS is located, continued to exhibit normal the fish and benthic communities structures.

Therefore, considering the historical construction, operation, and maintenance of BVPS, including previous dredging activities, this project is not expected to cause measurable impacts to the aquatic ecology.

Furthermore, the area to be dredged is within the 200 foot exclusion zone in which pleasure craft are prohibited from entering by the US Department of Homeland Security. Therefore, the project will not diminish recreational enjoyment of the Ohio River.

Alternatives The use of a barge for shipping and receiving the steam generators and reactor vessel head was determined to be the most practical. Alternatives such as over-the-road and rail were ruled out.

Shipping over-the-road by truck, even where possible, would impact local and regional traffic along the full route due to the size and weight of each component. Shipping partly by rail would also involve over-the-road shipping at some points, and therefore, it too was ruled out.

PROJECT LOCATION: THE PROJECT IS LOCATED along the left bank of the Ohio River, Mile 34.55-34.93, in Shippingport, Beaver County, Pennsylvania.

PERMIT CONDITIONS GENERAL CONDITIONS:

I. The time limit for completing the work authorized ends on December 31, 2011. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.

2. You must maintain the activity authorized by this permit in good condition and in conformance with the .terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you must make a good faith transfer to a third party in compliance with General Condition 4 helow, Shomld you wish to cease to maintain the authorized activity, or should you desire to abandon it without a good faith transfer, you may obtain a modification of this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archaeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Pllaccs.
4. If you sell the property associated with this permit, you must obtain the signature of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit.
6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
7. FURTHER INFORMATION:

1. Congressional Authorities: You have been authorized to undertake the activity described above pursuant to:

Section 10 of the Rivers and Harbors Act of 1899.

2. Limits of this authorization.
a. This permit does not obviate the need to obtain other Federal, state or local authorizations required by law
b. This permit does not grant any property rights or exclusive privileges.
c. This permit does not authorize any injury to the property or rights of others.
d. This permit does not authorize interference with any existing or proposed Federal project.
3. Limits of Federal Liability. In issuing this permit, the Federal Government does hot assume any liabhity for the following:
a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf of the United States in the public interest.
c. Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity authorized by this permit.
d. Design or construction deficiencies associated with the permitted work.
c. Damage claims associated with any future modification, suspension, or revocation of this permit.

4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided.
5. Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following:
a. Yotu fail to comply with the terms and conditions of this permit.
b. The information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (see 4 above).
c. Significant new information surfaces which this office did not consider in reaching the original public interest decision.

Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The ieferenced enforcement procedures provide for the issuance of an administrative order requiring you to comply with the terms and conditions of your permit and for the initiation of legal action where appropriate.

You will be required to pay for any corrective measures ordered by this office, and if you fail to comply with such directive, this office may in certain situations (such as this specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the cost.

6. Extensions. General, condition I estahlishes a time limit for the complction of the activity authorized by this permit. Unless there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest decision, the Corps will normally give favorable consideration to a request for an extension of this time limit.

6. IMPACT ON NATURAL RESOURCES: The District Engineer has consulted the most recently available information and has determined that the project is not likely to affect the continued existence of any endangered species or threatened species, or result in the destruction or adverse modification of habitat of such species which has been determined to be critical. This Public Notice serves as a request to the U. S. Fish and Wildlife Service for any additional information they may have on whether any listed or proposed to be listed endangered or threatened species may be present in the area which would be affected by the activity, pursuant to Section 7(c) of the endangered Species Act of 1972 (as amended).
7. IMPACT ON CULTURAL RESOURCES: The National Register of Historic Places has been consulted, and it has been determined that there are no properties currently listed on the register which would be directly affected by the proposed work. If we are made aware, as a result of comments received in response to this notice, or by other means, of specific archeological, scientific, prehistorical, or historical sites or structures which might be affected by the proposed work, the District Engineer will immediately take the appropriate action necessary pursuant to the National Historic Preservation act of 1966 - Public Law 89-665 as amended (including Public Law 96-515).
8. PUBLIC INVOLVEMENT: Any person may request, in writing, within the comment period specified in the paragraph below entitled "RESPONSES," that a public hearing be held to consider this application. The requests for public hearing shall state, with particularity, the reasons for holding a public hearing.
9. EVALUATION: Interested parties are invited to state any objections they may have to the proposed work. The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit~which reasonably may be expected to accrue from the proposals must be balanced against its-reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values,, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate'the impacts of this proposed activity. We in the Bridge Unit of the Pennsylvania Department of Transportation are concerned about the Shippingport Bridge which is located within these boundaripe and which may be affected by the dredging. We ask that any dredging in the proximity of the three bridge piers be addressed by the applicant prior to any approval being granted. We would want to know the specifics of the proposed activities, such as how close to the piers will the dredging occur and how will the river bottom be altered, as well as who will monitor compliance.

Dear Mr. Hanko:

I have reviewed the maps accompanying your recent correspondence, which concerns the above-referenced project in the Ohio River drainage, Beaver County, Pennsylvania: Based on records maintained in the Pennsylvania Natural Diversity Inventory (PNDI) database and our own records, the fbllowing rare or protected fish species falling under Pennsylvania Fish & Boat Commission (PFBC) jurisdiction are known from the Ohio River in the vicinity of each of the utility crossings:

The fish species are especially vulnerable to physical (dredging, rip-rap, etc.) and chemical (pH, dissolved oxygen, temperature, heavy metals and organic contaminants) changes to their aquatic environinent.

Although the mobile adults of these protected fish species may be capable of moving from the project area, their spawning grounds (including eggs, fry, and immature fish) are vulnerable to burial, crushing by equipment, and siltation from in-sti-eam construction projects. We are concerned about potential impacts to the fish, eggs and the hatching fry from the instream work associated with the proposed dredging. Therefore, we request that all in-stream activity be avoided from April 1 to July 1 in order to avoid adverse impacts during the spawning season for these species. Likewise, minimal erosion or sediment should be allowed to enter into the river (e.g., strict erosion and sedimentation control measures need to be employed).

I refer to your letter and modified drawing, received in this office by fax on July 8, 2005, requesting a modification to a Department of the Army Permit issued to you to perform maintenance dredging, as necessary, for a period of 10 years at the Beaver Valley Power Station, to insure adequate flow at intake and discharge structures and to maintain proper depth at the barge slip along'the Ohio River, left bank, Mile 34.55-34.93, in Shippingport, Beaver County, Pennsylvania.

Approval is granted to perform maintenance dredging up to approximately 50 feet beyond the area permitted under your Department of the Army Permit No. 200100242. This is a one-time request to ensure access to your barge slip in October for delivery of a new reactor vessel head and three new steam generators for your Unit I plant.

All other conditions of your Permit remain in full force and effect.

Dear Mr. Sacoulas:

This is in regard to the materials your company will dredge from the Ohio River at and near the Beaver Valley Power Station (BVPS) barge slip for FirstEnergy Nuclear Operating Company (FENOC), in support of our Steam Generator Replacement Project (SGRP). We have reviewed our permits and in accordance with the Pennsylvania Department of Environmental Protection (DEP) guidelines, have determined that the materials are suitable for disposal at the US Army Corps approved facility, Dredge Dock, that your company generally utilizes.

Per the DEP "Management of Fill" document (#258-2182-773 dated April 24, 2004), FENOC conducted its due-diligence in making the determination. An evaluation of the likelihood of contamination to the materials to be dredged, from' documented spill or release conditions from and near BVPS, was performed.

Nothing was found to indicate contamination in the area to be dredged.

Further in accordance with the fill policy, FENOC collected composite samples throughout the to-be-dredged area. These samples were analyzed for Resource Conservation and Recovery Act (RCRA) metals.

The-analyses report (copy attached) indicates that no concentration of RCRA metals exceeds the limits.

The information was further reviewed by our FirstEnergy Corporation solid waste subject matter and he concurrs that nothing precludes this material from being considered and used as clean-fill. Therefore, the materials may be disposed at the Dredge Dock facility unless visual contamination is observed during the dredging process.
