By memorandum, dated March 7,1978, I proposed to conduct the rufemneed .

inspection in the June-July 1978 time frame. Your concurmnce was received,

I now propose to postpone the inspection based upon the following technicaf and personal reasons: g

NRR-QAB. As we are all aware, substantive changes have been made which h will not be reviewed by licensing until the at least Amendment two (2)

b. Personal As of this date, I am planning on making the physical sove to the site area during the week beginning Monday, July 24. I have'not yet identified anything specific that.must be done in the week of July 11-14 to facilitate the move, but I'm sure that both sqy wife and I would be much more comfortable if I.wem not away during what will probably turn into a panic period. .

I would propose to conduct 35200 after the FSAR has been amended to cover the organizational changes and in unscheduled bits and pieces after I'm in residence at the site.

This refers to the inspection activities performed by our Resident In-spector, Mr. R. G. Taylor, of activities authorized by.NRC Construction Permit No. CPPR-127 for the Comanche Peak Steam Electric Station, Unit 2, and to the discussion of the findings by the inspector with members of your staff on February '15,1979.

( During the inspection, it was found that certain activities under your license appear to be in noncompliance with Appendix B to 10 CFR 50 of the NRC Regulations, " Quality Assurance Criteria for Nuclear Power Plants."

The item of noncompliance and references to the pertinent requirements are 4 identified in the enclosed Notice of Violation. Details of this item will be included in an inspection report to be issued in the near future and identified as Inspection Report No. 50-445/79-03; 50-446/79-03.

This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10 Code of Federal Regulations. Section 2.201 requires you to submit to this office, with-in 30 days of your receipt of this notice, a written statement or expla-nation in reply including: (1) corrective steps which have been taken by you, and the results achieved; (2) corrective steps which will be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved.

i NOTICE OF VIOLATION Based on the results of the NRC inspection conducted on February 15, 1979, it appears that certain of your activities were not conducted in full compliance with the conditions of your NRC Construction Permit No.

CPPR 127 as indicated below:

Failure to Follow Concrete Placement Procedure Criterion V of Appendix B to 10 CFR 50 requires that activities I affecting quality shall be accomplished in accordance with docu-mented instructions, procedures, or drawings of a type appropriate to the circumstances.

Project Quality Procedure Ql-QP-11.0-3 references Specification 2323-55-9, " Concrete," which invokes Section 8.3 of ACI 301-72 for depositing of concrete. Paragraph 8.3.3 of ACI 301-72 states that, " Concrete shall not be subjected to any procedure which will l cause segregation."

Concrete segregation was evidenced by flying coarse aggregate emanating from the stream of falling concrete.

This is an infraction.

Note: The inspection report transmittal letter and the report details will I

reflect that the condition was immediately corrected after being brought to the attending B&R QC Inspector. The letter will require that you address actions to prevent recurrence.
