COMANCHE PEAK REPORT 86-08/86-06

This confirms our telephone conversation of today, which I initiated following
early discussions with Jim Taylor concerning issuance of the sub,iect report.
The following summarizes the items discussed.
I
1.
The version of the inspection report which IE concurred in (signed by
!
Spessard) for issuance by Re ion IV (but which Mr. H. S. Phillips
i
does not choose to concur in
is not to be issued to the licensee at

this time, even though the report was processed consistent with
!
Reoion IV procedures.
2.
Mr. Phillips has been requested by IE (telephone call by Spessard on
this date) to revise the report (presented for Signature) to address
!
the " Issues in Dispute" (Phillips to Barnes memorandum of
j
January 6,1987) in a manner that would allow him to concur. The
i
revisiens are to be limited to those specific issues and are to be
I
consistent with IE Policy concerning inspection report writing and
enforcerrent matters.
Based on these discussions, Mr. Phillips
I
'
believes this could be accomplished within a few days after receiving
I
instructions from the Region IV Administrator, sir.ce he is working
directly for him at the present time.
I also told Mr. Phillips that
IE (Gower or Spessard, if necessary) would work with him via
telephone to answer any questions, etc., while he was working on the
revised report.
Also during these discussions, Mr. Phillips indicated that there may
be other parts of the inspection report which (in hindsight) he might
lite to revise esen though he was at one time willine to concur.
I
told Mr. Phillips that my primary interest was the issuance of the
inspection report so that the utility could act on the findings.
Therefore, I wanted to minimize the re-review process by restricting
!
'
its scope to cover only the " Issues in Dispute." However, I offered
that Mr. Phillips could (if he desired) provide a second revision
which would cover the " Issues in Ddspute" and revisions to the
initial report that are not in dispute.
IE will consider this
revision, in the re-review process, but our primary goal is to focus

on the " Issues in Dispute."

IE (Gower and Spessard) will review the revised report and discuss
the changes with Mr. Phillips and Region IV management in an effort
to resolve the issue,
i.e., an Inspection Report which can be
concurred in by all parties.

Jim Taylor will make the final decision regarding the issuance of the
inspection report, should the measures discussed above not resolve
!
the issues. Also, should this be necessary, Jim intends to personally
review the initial report including the revisions previously
)
discussed.
