i APPENDIX A Notice of Violation Baltimore Gas and Electric Company Docket / License Nos. 50-317; DPR-53 Calven Cliffs Nuclear Power Plant 50-318; DPR-69 During an NRC inspection conducted from November 15,1993 through November 19, 1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the following violations were identified.

1. 10 CFR 50, Appendix C, Criterion XVI, requires that, " Measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected."

Contrary to the above, between November 25,1991, and October 14,1993, BG&E failed to promptly address the condition that the service water system may have been unable to perform its design safety function under certain accident conditions, due to existing system leakage and the lack of a safety-related makeup water source.

Specifically, although the condition was identified in November 1991, an operability determination was not made until November 1992; a 10 CFR 50.59 Safety Evaluation for cross-connecting the saltwater and service water systems was not approved until March 1993; procedures for implementing the cross-connect were not incorporated into the operating instructions until October 1993; and operability guidance based on leakrate criteria was not provided to operators until October 1993.

This is a Severity 12 vel IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Baltimore Gas and Electric Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
