APPENDIX A NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket No.

50-318 Calvert Cliffs Nuclear Power Plant License No. DPR-69 As a result of the inspection conducted on May 16 - July 3,1989, and in accord-ance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy) (1988), the following violation was identified:

10 CFR : art 50, Appendix J, Sections III.D requires that Type B and C local leak rate tests (LLRT) shall be cuducted at intervals no greater than 2 years. A 28 day extension to this 2 year interval was granted by the NRC on March 18, 1989.

Contrary to the above, the following examples represent licensee failure to conduct the-respective Type B or C LLRT within the required 2 year and 28 day interval:

(1) The Type C local leak rate of penetration No. 41 was last performed on April 12, 1987, and as of July 3,1989, had not been conducted again.

(2) The Type C local leak rate test for penetration No. 38 was last per-formed on April 27, 1987, and was not performed again until June 2, 1989.

(3) The Type B local leak rate test of penetration No. 50 was last per-formed on May 27, 1987.

This penetration was disassembled without the conduct of a LLRT, a condition that precludes meeting the 2 year and 28 day maximum interval.

In the aggregate, this is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Baltimore Gas and Electric Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in l

reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full ccmpliance will be achieved.

Where good cause is shown, consideration will be given to extending this response time.
