4 NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket Nos. 50-317;50-318

-Calvert Cliffs Nuclear Power Plant License Nos. DPR-53; DPR-69 EA 98-225 During an NRC inspection conducted from March 30 to April 3,1998, three violations of NRC requirements were identified. In accordance with the " General Statement of Policy i

and Procedures for NRC Enforcement Actions," NUREG 1600, Revision 1, the violations are listed below:

'A.

10 CFR 50.65(a)(1) requires, in part, the holders of an operating license shall monitor the performance or condition of SSCs within the scope of the monitoring program as defined in 10 CFR 50.65(b) against licensee-established goals, in a manner sufficient to provide reasonable assurance that such SSCs are capable of fulfilling their intended functions. Such goals shall be established commensurate with safety. When the performance or condition of an SSC does not meet established goals, appropriate corrective action shall be taken.

10 CFR 50.65(a)(2) requires, in part, that monitoring as specified in 10 CFR 50.65 ta)(1)is not required where it has been demonstrated that the performance or condition of an SSC is being effectively controlled by performing appropriate preventive maintenance, such that the SSC remains capable of performing its intended function.

Contrary to the above, the licensee permitted a number of SSCs within the scope of the Maintenance Rule to remain under 10 CFR 50.65(a)(2) when preventive maintenance failed to assure that these SSCs remained capable of performing their intended function, as evidenced by the following examples, each of which constitutes a separate violation:

On July 10,1996, the licensee elected to place containment spray system L

_ under Section 50.65(a)(2). Following a repetitive functional failure, identified by the NRC, which occurred in March 1997, the licensee incorrectly allowed i

'this system to remain under 10 CFR 50.65(a)(2). The repetitive functional failure demonstrated that the preventive maintenance being performed on this system was not appropriate in that it failed to assure that the system i

remained capable of performing its intended function. The system should have been placed under 10 CFR 50.65(a)(1) following the repetitive failure.

On July 10,1996, the licensee elected to place the 4KV electrical distribution bus, instrument air system air amplifier, hydrogen recombiner, hydrogen analyzer and auxiliary feed water systems under Section L

50.65(a)(2). Following repetitive functional failures and/or excess j-

- unavailability times,'the licemee incorrectly allowed the systems to remain -

under 10 CFR 50.65(a)(2) for excessive periods of time ranging from three months to 1.5 years. The repetitivs functional failures and/or excess unavailability times demonstrated that the preventive maintenance being performed on these systems was not appropriate in that it failed to assure that the systems remained capable of performing there intended functions.

' established goals pursuant to the requirements of Section (a)(1), the licensee failed

, to demonstrate that the performance or condition of SSCs within the scope of 10 i

.CFR 50.65 had been effectively controlled by performing appropriate preventive L

~ maintenance. Specifically, the licensee had failed to establish performance measures for the system and was therefore unable to effectively demonstrate the system remained capable of performing its intended function.

Contrary to the above, as of July 1997, the licensee had failed to include vithin the

. scope of the Maintenance Rule program the portion of the emergency lighting -

. system located outside the control room, which is required for safe shutdown of the plant.

Pursuant to..the provisions of 10 CFR 2.201, Baltimore Gas & Electric Company is hereby required to submit ; a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility L

that is the subject of this Notice, within 30 days of the date of the letter transmitting this

-Notice of Violation (Notice).- This reply should be clearly marked as a " Reply to a Notice of Violation". and should include for each violation: (1) the reason for the violation, or, if g

~ taken and the results achieved, (3) the corrective steps that will be taken to avoid further contested, the basis for disputing the _ violation, (2) the corrective steps that have been L

violations, and (4) the date when full compliance will be achieved. Your response may

reference or include previous docketed correspondence, if the correspondence adeqmtely j

ATTACHMENT 1 CALVERT CLIFFS ENFORCEMENT CONFERENCE l

l PRINCIPAL NRC CONCERN BG&E apparently failed to adequately implement the Maintenance Rule by July 1996. Further, prior to the inspection BG&E was in possession of l

self-assessment type information that indicated that the program established would not be acceptable to the NRC.

VIOLATION 1 Contrary to 10 CFR 50.65(a)(2), BG&E permitted a number of SSCs within the scope of the Maintenance Rule to remain under (a)(2) status for extended periods of time after performance criteria was exceeded (nine examples were noted by the team, potentially many others).

The team identified a repetitive FF on the CS system that should have placed the system in (a)(1) status in March 1997. BG&E's tracking system

. failed to identify the CS system FFs as repetitive failures.

VIOLATION 2 Contrary to,10 CFR 50.65(a)(2), BG&E did not establish performance measures for the emergency diesel generator building HVAC system and

-therefore did not effectively demonstrate the system remained capable of performing its intended function.

VIOLATION 3 Contrary to 10 CFR 50.65(b)(1), BG&E feiled to inc!ade the emergency j

l PROGRAM ISSUES Lack of timeliness in resolving the use of the reliability index as a e

performance measure (identified in 5/96 & again in 10/97 self-assessments).
