ENCLOSURE 1 NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket / License Nos. 50-317; DPR-53 Calvert Cliffs Nuclear Power Plant 50-318; DPR-69 During an NRC inspection conducted from March 15 to April 18,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedures for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

10 CFR 50, Appendix B, Criterion Xill, " Handling, Storage and Shipping", requires that when necessary to prevent deterioration, protective environments be specified and provided for storage of equipment. This criterion is implemented by BGE Quality Assurance Policy 18.13, Handling, Storage, and Shipping. BGE Vendor Technical Manual Number 37708J, " Woodward EG-B10C Governor,"Section IV,

" Storage", states that Woodward governor units are to be protected against rust and contamination by filling the governor to the top with lubricating oil and reinstalling the shipping plugs if stored for more than 90 days before installing.

Contrary to the above, as of March 25,1998, a protective environment was not specified and provided for storage of a Woodward Governor. Specifically, a governor was stored for periods in excess of 90 days, including an approximate 10 year period, without being filled with lubricating oil. When the governor was placed in service on March 25,1998,it failed to operate as designed, which contributed to exceeding a diesel generator technical specification limiting condition for cperation.

This is a Severity Level IV violation (Supplement 1--Reactor Operations).

Pursuant to the provisions of 10 CFR 2.201, Baltimore Gas & Electric Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for violations A, B, and D: (1) the reason for the violation, or,

'if contested, the basis for disputing the violation or severity level, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed couespondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
