Dear Mr. Foley; This letter is in regard to your letter of June 2,1999, which responded to our letter an.s Notice of Violation (NOV) dated May 12,1999. In your letter, you did not contest the violation, and you informed us of your corrective actions taken to avoid further violations. No further action will be taken at this time. However, you should be aware that engagement in any similar wrongdoing in the future mr2y result in more significant enforcement action. j You are not required to respond to this letter, in accordance with 10 CFR 2,790 of the NRC's

" Rules of Practice," a copy of this letter with your home address deleted will be placed in the NRC Public Document Room (PDR).

This purpose of this statement is to respond to the Notice of Violation that I received from your Office, dated May 12,1999. I do not wig to contest this enforcement action.

The reasons for the violation:

It is my belief that my over-confidence, my complacency, my focus of"getting thejob done", a culture ofinconsistent and inadequate procedural compliance, and a lack of corrective feedback led to my unacceptable survey practices and documentation. It is also my belief that some or all of these factors I contributed to my assuming that procedural compliance, survey practices and documentation were accurate and complete during questioning by your Office.

The corrective stens that have been taken and the results achieved:

Disciplinary actions were taken by CYAPCo against me. In addition, I was placed on a performance monitoring and evaluation period with no Lead IIcalth Physics responsibilities. This performance monitoring and evaluation period was completed successfully and I have since returned to full Ilealth Physics Technician duties and responsibilities. My own reflections, new CY Management, new Health

(_) Physics Management, and new Ilealth Phpics Standards and Expectations have allowed me to better understand the seriousness of, and necessity for, strict procedural compliance and accurate and complete documentation.

The corrective stens that have been taken to avoid further violations:

Individual and departmental emphasis is placed on new IIcalth Physics Standards and Expectations for procedural compliance and documentation. This was accomplished through individual and departmental training for new IIcalth Physics procedures. In addition, I now try to maintain a conservative, questioning ;

attitude rather than one of"getting thejob done". It is my belief that my work performance since December of 1996, including working on the Radiation Protection Improvement Plan, has demonstrated my commitment to rigorous procedural compliance.

I believe that the above issues have been resolved and I hope that no further action by your Office is necessary. Please contact me if additional informt. tion is necessary.
