SUBJECT: NRC INTEGRATED INSPECTION REPORT 50-213/98-01 AND NOTICE OF

VIOLATION

Dear Mr. Mellor:

On, April 13,1998, the NRC completed an inspection at Connecticut Yankee Atomic

Power Company. The enclosed report presents the results of that inspection. During the

three month period covered by this inspection, the Haddam Neck staff assured safe

storage of the spent fuel as activities continued to prepare for decommissioning. Progress

was noted in the actions to improve the radiological controls program, to continue with

characterization and to plan remediation of on site and offsite areas, to address past

weaknesses in the licensing and design basis, and to implement modifications in support of

the nuclear island. Generally good performance was noted in operations, maintenance and

engineering support for decommissioning, security, and in the conduct of an emergency

preparedness training drill. Areas that require further NRC review include the maintenance

of freeze and flood protection measures, and the application of quality for the nuclear

island.

Our inspection identified that one activity was not in full compliance with NRC

requirements, as described in the enclosed Notice of Violation. The violation involved

modifying the seismic monitoring instrumentation as described in the safety analysis report

and the technical specifications without obtaining prior NRC approval as required by 10

CFR 50.59. Although improvements have been noted in the programs to establish and .

'

maintain the licensing basis, the violation indicates that weaknesses in this process

warrant your continued attention. In your response to the enclosed Notice, please describe

why the corrective actions in response to the May 12,1997 enforcement action did not

prevent this violation.

The violation is cited in the enclosed Notice, and the circumstances surrounding the

violation are described in the enclosed report. Please note that you are required to respond

to this letter and should follow the instructions specified in the enclosed Notice when

preparing your response. The NRC will use your response, in part, to determine whether

further enforcement action is necessary to ensure compliance with regulatory

requirements. '
