I. SECY-87-289 - Supplemental Order Expediting Appeal (In the

_!_latter of Pacific Gas and Electric Company)

The Commission, by a 5-0 vote, approved an order which provides for an expedited completion of the administrative appellate process in the Pacific Gas and Electric Company's proceeding on installation of high-density racks in both spent fuel storage pools at the Diablo Canyon Nuclear Power Plant. The order directs the Appeal Board to issue a decision on this matter on or before January 22, 1988, or by January 31, 1988, upon a prior showing in writing of exceptional circumstances warranting a delay.

(Subsequently, on November 25, 1987, the Secretary signed tha Order.)

II. SECY-87-273/273A - Response to Pending Motions Before the Commission in the Seabrook Proceeding The Commission, by a 4-1 vote, approved an order responding to a September 21, 1987, motion from Public Service of New Hampshire (applicants) to lift the Commission's stay barring low power operations at Seabrook and a motion by interveners which requested an evidentiary hearing on the applicants utility plan.

The order grants the applicants' motion to vacate the stay and denies the interveners' motion for a hearing. Finally the Commission dismissed as unripe all other motions seeking to stay low power. They may be refiled later at the appropriate time. Commissioner Rogers approved in part and disapproved in part and had additional comments. He would have preferred, prior to the lifting of the stay, that the Commission have in hand additional information he believed relevant to complete the summary review of the plan contemplated by CLI-87-02 and 8712110134 871207 PDR 10CFR PT9.7 PDR

t 2-CLI-87-03. The Commission order also noted that lifting the stay does not itself authorize a low power license for Seabrook because other matters now pending before the Licensing Board or Appeal Board may need to be resolved before a low power license can be issued.

(Subsequently, on November 25, 1987, the Secretary signed the Order.)
