I. SECY-86-209 - Diablo Canyon Reracking License Amendment - -

Court Injunction The Commission, by a 3-1 vote, approved an order responding to a request for a stay of the immediate effectiveness of two license amendments issued by the NRC staff on May 30, 1986. The amend-ments authorized the Pacific Gas and Electric Company to rerack the spent fuel pools at both units of its Diablo Canyon Nuclear Power Plant.

The order stayed, pending completion of the on-going license amendment hearing and initial decision, that portion of the amendments which authorized PG&E to store in excess of 270 fuel

- assemblies in either of the two pools at Diablo Canyon. In all other respects the order denied the petitioners request for a stay. Commissioner Asselstine disapproved and provided separate views. Chairman Zech and Commissioners Roberts and Bernthal also provided additional views in response to Commissioner Asselstine.

(Subsequently, on July 22, 1986 the Secretary signed the Order.)
