SECY-87-68A - Northern States Power Company (Control Room

The Commission, by a 3-2 vote,* approved an order which completed the Commission's consideration of issues related to an October 20, 1986 NRC staff order to Northern States Power Company which directed the licensee to show cause why its operating license should not be modified to prohibit the use of radios, tapes, and television sets, or other audible entertain-ment devices in the control room of the Prairie Island and Monticello nuclear facilities.
The order rescinds the October 20, 1986 staf f order and dismisses the proceeding.
Chairman Zech and Commissioner Carr disapproved the order and provided dissenting views noting that they would have allowed the proceeding to take its normal course.
(Subsequently, on May 1, 1987, the Secretary signed the Order.)
- Section 201 of the Energy Reorganization Act, 42 U.S.C.
S5841, provides that action of the Commission shall be deter-mined by a " majority vote of the members present."
Commissioner Asselstine was not present when this item was affirmed.
In order to allow the will of the majority to prevail, Chairman Zech did not participate in the formal vote of the Commission.
Accordingly, the formal vote of the Commission was 2-1 in favor of the decision.
Chairman Zech and Commissioner Asselstine, however, had previously indicated that they would, respectively, disapprove and approve this paper and had they been present they would have af firmed their prior votes.

SECY-87 Emergency Preparedness Rulemaking The Commission, by a 4-1 vote,* approved a final rule which changes the requirement for a full participation off-site exercise from within one year to within two years of issuance of an operating license for full power.
Commissioner Asselstine disapproved and provided additional comments to be published with the rule.
(Subsequently, on April 30, 1987, the Secretary signed the Federal Register Notice and the rule was forwarded for publication.)
