This is in response to your letter dated October 7,1988, in which you appealed Mr. Donnie H. Grimsley's response dated September 8, 1988.
Mr. Grimsley's response denied in whole or in part twenty records subject to your Freedom of Information Act (F0!A) request concerning inspections and investigations into H and G Inspection Company with regard to the South Texas Plant.
This resporse will address the records identified on the enclosed copies of Appendix D, numbers 1 through 6, and Appendix E, numbers 1 through 13 of Mr. Grimsley's response. Mr. Chilk's letter dated October 31, 1988, responded to the record identified at number 14 of Appendix E.
Acting on your appeal, I have carefully reviewed the records in this case and have determined that the previously withheld information will continue to be withheld from public disclosure pursuant to Exemotions (5), (6) and (7)(C) of the FOIA (5 U.S.C. 552(b)(5), (6) and (7)(C)) and 10 CFR 9.17(a)(5), (6) and (7)(111) of the Comission's regulations. Therefore, your appeal is denied.
The exemptiens for the denied information are identified with the description of each record listed on the appendices. The information that continues to be withheld pursuant to Exemption (5) of the FOIA is predecisional information consisting of advice, opinions, and recomendations of the staff. Release of the information would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. There are no reasonably segregable factual portions of the records. Information continued to be withheld pursuant to Exemptions (6) and (7)(C) consists of names and other identifying information, the disclosure of which would cause a clearly unwarranted invasion of personal privacy. I am unable to identify any legitimate public interest in the release 1
of this information which outweighs the privacy interests of the individuals.

This is an appeal pursuant co subsection a(6) of the Freedom of Information Act as amended (5 U.S.C. 552), of the actual denial to release documents, requested on April 7, 1988, by the Garde Law Office.
By letter dated September 8, 1988, Donnie H. Grimsley, Director of the Division of Rules and Records, informed us that all of Appendix D, E1 - E9, E E13 is being withheld from disclosure in their entirety or in part, pursuant to FOIA Exemption 5, 6, 7,7(C) because; the withheld information consists of intraagency records that are not available through discovery during litigation. Disclosure of predecisional information would tend to inhibit the open and frank exchange of ideas essential to the deliberative process (5); because the withheld information is exempted from public disclosure because its disclosure would result in a clearly unwarranted invasion of personal privacy (6);
because it consists of investigatory records compiled for law enforcement purposes and is being withheld for the reason (s) indicated (7); and disclosure would constitute an unwarranted invasion of personal privacy (7C).
We believe we are entitled to the release of the documents being withheld.
