his is in response to your letter of July 23, 1987 in which you request that the E make Mr. Stello, Mr. Martin ard Mr. Westenren available for deposition "for the purpose of e>ploring their conduct in investigating safety allegations of ruclear workers, inspecting ruclear facilities, ard enforcing nuclear safety requireTents."

As you knou, on July 15, 1987 the Conmission responded to a May 29, 1987 petition by CAP relating to allegations concerning the South Texas Project.

D e Ccnmission stated that "the agency can best determine whether the allegations should be hardled by Region IV personnel or by an IMependent task force only af ter detailed review of the nature of the allegations." It is clear that the Ccomission believes that the next appropriate step is for CAP to provide the allegations to the E proTptly. We do not believe that ccTplying with your request would be consistent with the Cmmission's response to CAP's May 29, 1987 petition.
