' APPENDIX A NOTICE OF VIOLATION Yankee Atomic Electric Company Docket No. 50-29 Yankee Nuclear Power Station License No. DPR-3 As a result of the inspection conducted on August 21 - October 1,1990, ar.d in accordance with the

  • Genera! Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part

' 2,' Appendix C (Enforcement Policy 1990), the following violation was identified:

10 CFR.50, Appendix B, Criterion XVI, Corrective Action, requires measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and eqtupment, and nonconformances are promptly identified and corrected. In the case of significant conditions adverse to quality, the measures shall assure that the cause of the conditior. is determined and corrective action taken to preclude repetition.

Contrary to the above, corrective action implemented as a result of the four consecutive fClures of the emergency lighting surveillance test on December 7, I m , 1989, did not assure that defective equipment was promptly identified and  !

I corrected in that corrective actions did not include sufficient additional testing of emergency lighting. As r. result, on June 29, 1990, additional failures of emergency lighting occurred, identifying that corrective actions had failed to preclude repetition.

This is a Severity Level IV violation (Supplement I).

. Pursuant to the provisions of 10 CFR 2.201, Yankee Atomic Electric Company is hereby

. required to' submit a written statement or explanation to the U.S. Nuclear Regulatory o _ Commission, ATI'N: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked

as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective. steps that wiH 6 taken to avoid further violations, and (4) the date when full compliance will be achieved. if an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may o be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

The response directed by this Notice is not subject to clearance by the Office of Management and Budget under the Paper work Reduction Act of 1930, PL 96-511.
